  • Diagnostic evaluation for major depressive disorder, persistent depressive disorder, postpartum depression, or mixed anxiety-depression when the plan covers outpatient mental health
  • Follow-up medication management visits, including video visits with an in-network clinician licensed in New York
  • Therapy or skills-based visits when your plan includes behavioral health outpatient care

Federal MHPAEA requires many group health plans and issuers that cover mental health or substance use disorder benefits to apply financial requirements and treatment limits that are no more restrictive than those for medical/surgical benefits in the same classification (CMS MHPAEA overview).

New York also has long-standing mental health coverage mandates in Insurance Law §§ 3221 and 4303, often discussed as Timothy’s Law. DFS Circular Letter No. 7 (2014) reminds issuers of those statutes together with MHPAEA (DFS Circular Letter 7).

For telehealth, DFS states that individual and group policies delivered in New York, including NY State of Health and NYSHIP, may not exclude a service that is otherwise covered solely because it is delivered via telehealth. If the policy would cover the service in an in-network office, the insurer is required to cover it when an in-network clinician delivers it by telehealth, subject to reasonable utilization management that matches in-person care (DFS FAQ).

That still leaves deductibles, copays, medical-necessity review, and network rules intact.
