Humana in New York, for most Klarity readers, means Medicare Advantage (MA), not a commercial employer plan. Coverage for depression evaluation, therapy, and medication may apply under federal Medicare Advantage rules, not New York Timothy’s Law. Humana typically markets Medicare Advantage in New York, not large commercial book-of-business coverage. Depression care on an MA plan may include outpatient visits, some telehealth, and Part D or MAPD pharmacy benefits through Humana Pharmacy Solutions (HPS). Timothy’s Law (New York Insurance Law §§ 3221 and 4303) does not control Medicare Advantage. Federal rules in 42 CFR Part 422 and your plan documents do.
SSRIs, SNRIs, and many other antidepressants are not governed by Cigna’s stimulant PA policy IP0477. Humana still may require prior authorization, step therapy, or quantity limits on specific drugs. Timothy’s Law requires many state-regulated commercial policies in New York to cover mental health on par with medical/surgical benefits. Medicare Advantage is a federal product. CMS, not the New York Department of Financial Services, sets the coverage floor. DFS still may help with some consumer questions at (800) 342-3736, but MA medical necessity and appeals follow CMS processes first.

Plans often list outpatient psychiatric evaluation, medication management, and psychotherapy with in-network clinicians. Telehealth may appear as a covered setting when the clinician and location meet plan and DEA rules. HHS/DEA telemedicine flexibilities for prescribing currently extend through December 31, 2026; your plan can still impose its own network and documentation rules.
Pharmacy coverage sits on Part D or the MAPD formulary. HPS administers many Humana drug lists. A medication that is “typical” for depression still may sit on a higher tier, need a PA, or require a preferred alternative first.

Cigna Express Scripts policy IP0477 (effective May 15, 2026) requires prior authorization for stimulants. That policy does not govern Humana, and it does not apply to SSRIs or SNRIs even on Cigna. Humana HPS may still PA certain antidepressants, antipsychotics used as adjuncts, or esketamine/Spravato when those appear on the formulary.

New York Insurance Law §§ 3217-h and 4306-g address telehealth for many commercial policies. MA follows CMS and the plan’s telehealth exhibit. Originating-site and distant-site rules, audio-only limits, and controlled-substance prescribing all sit in the Evidence of Coverage plus federal law.

MA organization determinations and reconsiderations follow CMS managed-care appeals rules (42 CFR Part 422, Subpart M). After the plan’s reconsideration, many Part C cases go to the Independent Review Entity. Maximus Federal Services is the Medicare IRE. DFS at (800) 342-3736 does not replace the CMS appeal clock. Use both only when the issue actually sits in DFS jurisdiction.
New York Medicaid, including managed Medicaid, is not Humana MA. Dual-eligible members may have Medicaid wrap benefits that Humana does not administer. Do not assume a Humana MA denial is the last word if you also have Medicaid. Contact New York Medicaid or your dual special needs plan (D-SNP) coordinator.
